Except for liability that cannot be limited or excluded by law (for example in respect of death or personal injury caused by negligence), our aggregate liability to you in respect of any loss or damage arising under or in connection with these Terms shall be limited to direct losses up to the amount paid by you for the particular Service in the 12 months prior to the event giving rise to the claim, or €1,000 if no payment was made, whichever is greater. This clause does not affect your statutory rights where you are a consumer.

Where the Service includes paid services, fees, payment terms and refund policies will be stated at the point of sale. All payments are subject to the terms provided at purchase and applicable law.
9. Termination
We may suspend or terminate access to the Service at any time for breach of these Terms or for operational reasons. Termination does not affect accrued rights or obligations.

We may update these Terms from time to time. If changes are material we will provide reasonable notice (for example, by posting a prominent notice on the Service or sending email to registered users where applicable). Continued use of the Service after the changes constitutes acceptance.
11. Governing law and disputes
These Terms are governed by the laws of Malta. For disputes, we encourage you to contact us first so we may attempt to resolve the matter. You also have the right to bring a claim before the Maltese courts or to lodge a complaint with the Maltese Data Protection Commissioner in respect of privacy matters.

The Company processes personal data in accordance with its Privacy Policy. Data subject requests (access, rectification, erasure, restriction, portability and objection) should be directed to info@maltaresidencyprograms.com. We will respond in accordance with applicable law and will verify requests to protect privacy.
13. Consumer rights
Nothing in these Terms affects your statutory rights as a consumer under applicable Maltese and EU law. If you are a consumer, certain clauses such as exclusions of liability may not apply to the extent prohibited by law.
